Welcome to CarShareNova! These terms and conditions ("Terms of Service") govern your use of CarShareNova’s luxury and exotic car-sharing platform. Whether you are renting a vehicle or listing your vehicle, you agree to comply with these terms as a legally binding agreement between you and CarShareNova. By registering on our platform, you agree to be bound by these Terms of Service, our Privacy Policy, and other guidelines or policies that may apply to your use of CarShareNova’s services. 1. General Terms

The following terms apply to all users of CarShareNova.

1.1 Registration and Verification

When you sign up for CarShareNova, you are required to provide accurate and complete information, including your driving record (for renters) or vehicle information (for owners). CarShareNova may use third-party services to verify the information provided. You authorize CarShareNova to collect, use, and store such information in accordance with POPIA (Protection of Personal Information Act). Car owners are responsible for verifying the renter’s driver’s license at the time of vehicle pickup. Failure to verify may release CarShareNova from liability.

1.2 Ongoing Information Updates

It is your responsibility to keep your account information up to date. This includes any changes to your driving record, contact information, or vehicle details. CarShareNova may deliver important notices via email or phone to the most recent contact information provided.

1.3 Incorporation of Additional Terms

These Terms of Service include all relevant CarShareNova policies, guidelines, and frequently asked questions (FAQ). By using the platform, you agree to comply with these terms as part of the overall agreement.

1.4 Your Commitments

By using CarShareNova, you agree that:

You have the legal right to use the platform and comply with all applicable laws.
Your activities will not infringe upon anyone else's rights or breach any legal obligations.
You will not use the platform for illegal or unauthorized purposes, including transporting illegal substances or items.

1.5 Termination

You may discontinue your use of CarShareNova at any time. CarShareNova reserves the right to terminate your account at its discretion if you violate these terms or engage in misconduct. Termination does not release you from any obligations incurred prior to termination.

2. Terms for Renters

The following terms apply to users who rent vehicles through CarShareNova.

2.1 Renting a Vehicle

To rent a car through CarShareNova, you must:

Be at least 30 years old.
Hold a valid driver’s license.
Provide accurate information regarding your driving history.

Failure to meet these requirements may result in the cancellation of your booking or suspension of your account.

2.2 Payment of Fees

Renters must pay the rental fee upfront at the time of booking. CarShareNova will hold the payment until the rental period is completed. If applicable, a security deposit may also be required, which will be returned within 5-7 business days after the rental period ends, provided no additional fees or damages are incurred. You authorize CarShareNova to charge your account for any additional fees, including excess mileage, parking tickets, or damages. Non-payment of fees may result in legal action and suspension of your account.

2.3 Insurance and Liability

Renters agree to maintain a valid driver’s license and comply with all applicable laws and regulations during the rental period. The renter is fully responsible for any damage to the vehicle, including damage from potholes, dust storms, hail, gravel roads, and sand roads. The renter acknowledges and accepts liability for such damage and is responsible for ensuring that their personal insurance coverage is adequate and extends to the use of the vehicle. CarShareNova provides no insurance coverage beyond the waivers selected by the renter at booking, and the renter should review and choose appropriate waiver options to understand the coverage and costs.

2.4 Vehicle Use

As a renter, you agree to:

Use the vehicle for personal use only, and not for commercial purposes (e.g., ride-sharing).
Exercise reasonable care when using the vehicle, adhering to all traffic laws and regulations.
Return the vehicle on time and in the same condition as when it was received.

Misuse of the vehicle or failure to comply with these terms may result in penalties or legal action.

2.5 Incident Reporting

In the event of an accident or damage, you must immediately report the incident to CarShareNova and, if applicable, the police. You must provide all relevant details, including witness information, insurance details, and a police report number.

3. Terms for Owners

The following terms apply to users who list their vehicles on CarShareNova.

3.1 Listing Your Vehicle

Owners are responsible for ensuring that their vehicle meets CarShareNova’s listing criteria. You must provide accurate information about your vehicle, including its condition, availability, and location. You are responsible for ensuring your vehicle is roadworthy, properly maintained, and compliant with local regulations.

3.2 Rental Fees and Payments

Owners can set their own rental rates. CarShareNova will pay you the rental amount collected, minus our commission and any applicable fees, taxes, or charges. CarShareNova will process your payment within 5 business days of a successfully completed trip. The payment will be transferred directly to your bank account. You are responsible for reporting any rental income for tax purposes.

3.3 Insurance and Liability

CarShareNova has partnered with a reputable insurance provider, PetroSure, to offer comprehensive commercial coverage for vehicle owners, allowing them to drive and rent out their vehicles with peace of mind. Owners who choose not to utilize the comprehensive commercial insurance provided by PetroSure assume full responsibility for any damage or loss to their vehicle during the rental period, including damage resulting from accidents, theft, vandalism, or other causes. In such cases, the owner must ensure they have their own comprehensive insurance coverage that includes protection for renting out their vehicle.

4. Cancellations and Refunds

Cancellations must be made at least 24 hours before the scheduled rental start time to receive a full refund. If a cancellation is made within 24 hours of the rental start time, you may be charged a cancellation fee. CarShareNova reserves the right to adjust cancellation policies and fees at its discretion.
